"Case filed by son-in-law opposing the arrest of Sundaresa Iyer under Goonda Act. High court's notice to Government."

Chennai Feb 4: The High Court has sent a notice to the Government to file a response petition in connection with the case filed opposing the arrest of Sundaresa Iyer for one year under Goonda act.

Judges M. Karpagavinayagam and T. M. Masilamani heard the habeas corpus petition filed by Sundaresa Iyer's son-in-law Mr. Ananthanarayanan on Thursday. They have ordered the notice to be sent to the Kanchipuram district collector and to the prohibition control officer asking them to present a response within 4 weeks.

The petition says:

"The order on Jan. 21st by Kanchipuram District collector without any hearing to arrest Mr. Sundaresa Iyer for one year under the Goonda's Act is illegal.

Sundaresa Iyer a law abiding citizen. He studied B.Com in Nagpur University and got a Gold Medal for standing first in the University.

He worked in Reserve bank for 36 years. After his retirement, he was serving as manager in the Sankara mutt. Only criminals who disturb the public peace are to be put under Goonda's Act by law. To put Sundaresa Iyer, who has done nothing wrong under the Goonda's Act is very unjust.

He has no connection to the Shankararaman’s murder. The reasons given for putting him under goonda act are very flimsy. A false case has been foisted on him. To ensure that he is denied liberty [on bail] in this case, he has been detained under this [act] and put in jail for one year.

He should be ordered to be freed from Chennai central prison immediately, says the petition.
