Her Police fabricating statements: one more tangible example

On Feb. 3 Junior Acharya’s brother Raghu said he had not given any confession statement to any one. He told the journalist that there was not even an iota of truth in the report appeared in the media and that it read like a film script.

Raghu was actually referring to a report appeared in the New Indian Express (Jan. 31, 2005) which quoted extensively Raghu as having stated that “Rs. 15 lakhs given as junior seer’s share of hit money”. Further, the said news report goes on to say that this is what “Raghu has said in his statement to the Special Investigating Team (SIT) of the state police investigating the case.” Evidently, in the light of Raghu’s emphatic denial made today, it is Jayalalithaa’s police who have fabricated this statement in the name of Raghu.

In this context, the counsel for the Math have already moved the higher judicial authorities for getting a copy of this so-called Raghu’s statement filed by the Prosecution in Kanchipuram Judicial Magistrate Court-1. Though as defense lawyers, they are entitled to get copies of the statement given by their client (Raghu) under Section 161 of Indian Penal Code, their pleas with the Magistrate Court failed to evoke positive response.

Only copies of the first information report, remand report and bail dismissal orders were served. This unusual practice impaired their efforts at filing and defending their case for bail application moved on behalf of Raghu in the lower court, counsel said. Hence petitions seeking appropriate directions have been forwarded to the Chief Justice of India, Supreme Court; the chief Justice of Madras High Court; the district Sessions Judge and the Chennai Judicial Magistrate. Petitions have also been sent to the National and State Human Rights Commission.

It should be noted that the said report appeared in the New Indian Express just a day before Jayalalithaa’s Police justified in the Madras High court about the freezing of the 183 bank accounts of the Kanchi Math. It is thus oblivious who leaked out the so-called Raghu’s statement to the Press.

Moreover, on 2nd Feb. when the news about the Senior Acharya moving the Madras High Court seeking anticipatory bail (on Feb.1) in yet another case regarding the Bank accounts of the Math appeared, simultaneously another report pupated to be from the Police sources (SIT) on “Irregularities in trust accounts being probed” giving financial details almost similar to the one appeared in the said TNIE report also appeared in another local English media. So, one can very well imagine why these details were leaked out to the media by Jayalalithaa’s police.
